These terms are an agreement between you and Winner's Win ("we", "us"). By creating an account, joining someone's circle, or otherwise using the Winner's Win app or website (the "Service"), you agree to them. If you don't agree, please don't use the Service.
You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your phone and account secure.
Winner's Win uses Apple's Screen Time and network features on your own device to block gambling websites and apps you choose, and lets people you invite (your "circle") receive alerts and approve changes. You set this up on yourself, voluntarily.
No blocking tool is complete. New gambling sites appear daily, and determined users can find workarounds, including other devices, other networks, cash betting, or changing device settings. We do not promise that the Service will block every site or app, detect every attempt, or deliver every alert. You remain fully responsible for your own gambling and financial decisions.
Circle members are people you choose. They are not our employees or agents, are not professionals, and have no duty to you or to us. They may miss alerts, decline requests, or leave your circle. We are not responsible for anything a circle member does or doesn't do. If you join someone else's circle, you agree to use what you learn only to support them and to keep it private.
Winner's Win needs an active free trial or subscription for the person it protects. Plans are billed through your Apple Account. A 7-day free trial may be offered; the plan renews automatically at the price shown unless you cancel at least 24 hours before the trial or the current period ends. Manage or cancel in Settings, your name, Subscriptions. Billing, renewal and refunds are handled by Apple under its terms. If your subscription ends, blocking stops and your circle is told. Deleting your account does not cancel your subscription. Circle members (helpers) never pay.
You can ask to delete your account at any time in the app under Settings. Your circle is told, and the account is deleted 72 hours later. Only you can cancel the request in that time; no one in your circle can stop it. With no one in your circle, it is deleted right away. Deleting removes your account, circle and block list. Deleting your account does not cancel your Apple subscription; cancel it in Settings, your name, Subscriptions. We may suspend accounts that misuse the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR EFFECTIVE.
TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY GAMBLING LOSSES, LOST MONEY, LOST DATA, OR HARM TO RELATIONSHIPS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50.
You agree to cover our reasonable costs if a claim is brought against us because of your misuse of the Service or your breach of these terms.
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved individually, not as part of a class action, in the state or federal courts located in New York, unless the law where you live requires otherwise.
We may update these terms. If a change is significant, we'll let you know in the app. Continuing to use the Service after that means you accept the updated terms.
